The battle to wear ‘I heart boobies’ bracelets to go to U.S. Supreme Court

Two girls from Easton ISD in Pennsylvania will soon face the U.S. Supreme Court.

The girls were suspended from their junior high in 2010 for wearing “I heart boobies” bracelets to school. The school district had previously banned the bracelets for lewd speech.

The students sued the school district claiming is was a violation of their first amendment rights.

The students, Brianna Hawk and Kayla Martinez, wore the bracelets on their school’s designated breast cancer awareness day.  The case went to court where the judge sided in favor of the students and rejected the school’s claim that the bracelets are “lewd”. The school district appealed the decision. The case was presented in several courts, and the girls continued to win.

In a Easton ISD school board meeting in October, the board voted 7-1 to file a petition to take the case to the Supreme Court reiterating its claim that its “concerned about the implications of a hyper-sexualized environment” the bracelets could cause.

“It doesn’t seem ethical for the school to ban the bracelets on a day (they) designated for (breast cancer awareness),” senior Shane Marnell said.
